Terms of Service

These terms are the agreement between you and Clearview Systems LLC ("we", "us") for using the Benchmarq app. By using Benchmarq, you agree to them. If you do not agree, please do not use the app.

Who can use it

You must be at least 13 years old to use Benchmarq (or older where your country sets a higher minimum age for this kind of service). Benchmarq is not directed to children under 13.

Acceptable use

Benchmarq is a shared, anonymous game, and its results are only meaningful if answers are genuine. You agree not to:

• Submit automated, scripted, or bulk answers, or otherwise try to distort or manipulate the aggregate results;
• Create large numbers of identities to influence outcomes;
• Probe, attack, overload, or attempt to gain unauthorized access to the app or its backend;
• Reverse engineer the service except to the limited extent that law expressly permits;
• Copy, scrape, republish, or redistribute the question content or other materials from the app;
• Use the app in any way that breaks the law or infringes others' rights.

Your answers

When you answer, you contribute an anonymous data point to the aggregate totals. You grant us permission to use those anonymous responses to compute and display distributions and to operate and improve the service. Because responses are anonymous and quickly aggregated, they cannot be attributed back to you. How we handle this data is described in our Privacy Policy.

Share images

The app can generate an image of your result for you to share. That image is yours to share. The underlying app design, question content, wordmark, and brand remain ours (see below).

Our intellectual property

The Benchmarq app, its question content, wordmark, logo, look and feel, and all related materials are owned by Clearview Systems LLC and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. We reserve all rights not expressly granted.

Availability and changes

We may add, change, suspend, or discontinue any part of Benchmarq at any time, including questions, features, or the service as a whole. We may also update these terms; if we make material changes we will update this page and its date, and where appropriate note the change in the app. Continuing to use Benchmarq after a change means you accept the updated terms.

Disclaimer of warranties

Benchmarq is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that the aggregate figures are accurate or representative of any wider population.

Limitation of liability

To the fullest extent permitted by law, Clearview Systems LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or reliance on Benchmarq. Nothing in these terms limits liability that cannot be limited under applicable law, and some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules, except where your local law requires otherwise. Any dispute arising out of or relating to these terms or the app will be brought exclusively in the state or federal courts located in Texas, and you and we consent to the personal jurisdiction and venue of those courts.
